1. AGREEMENT TO TERMS

By accessing or using my11plus.uk (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. DESCRIPTION OF SERVICE

my11plus.uk provides online practice tests and educational materials for students preparing for the 11+ examination, including:
- Maths, English, and Verbal Reasoning practice questions
- Timed practice tests
- Parent dashboard with real-time progress tracking
- Topic-level performance analytics
- Week-by-week improvement charts

3. ELIGIBILITY

3.1 The Service is intended for use by:
- Parents/guardians creating accounts for their children aged 9-11
- Students aged 9-11 under parental supervision

3.2 By creating an account, you represent that:
- You are at least 18 years old (for parents/guardians)
- All information provided is accurate and current
- You have authority to bind any minor to these Terms

4. ACCOUNT REGISTRATION

4.1 You must create an account to access premium features.

4.2 You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use

4.3 We reserve the right to suspend or terminate accounts that violate these Terms.

5. SUBSCRIPTION AND PAYMENT

5.1 Pricing
- Free trial: 7 days (no credit card required)
- Monthly subscription: £4.99/month after trial
- Prices subject to change with 30 days notice

5.2 Billing
- Subscriptions automatically renew monthly
- Payment processed via Stripe on the renewal date
- You authorize us to charge your payment method

5.3 Cancellation
- Cancel anytime with one click from your account dashboard
- Cancellation takes effect at the end of the current billing period
- No refunds for partial months

5.4 Free Trial
- One free trial per user
- Cancel before trial ends to avoid charges
- Access to all premium features during trial

6. REFUND POLICY

6.1 We offer refunds in the following cases:
- Technical issues preventing Service access (if not resolved within 7 days)
- Duplicate charges or billing errors
- Cancellation within 48 hours of first payment

6.2 Refund requests must be submitted to josh.sutcliffe.personal@gmail.com within 30 days of charge.

6.3 No refunds for:
- Change of mind after using the Service
- Failure to cancel before trial ends
- Partial month usage

7. USER CONDUCT

You agree NOT to:
- Share your account credentials with others
- Use the Service for commercial purposes without permission
- Copy, reproduce, or distribute content without authorization
- Attempt to hack, reverse engineer, or compromise the Service
- Upload malicious code or interfere with Service operations
- Violate any applicable laws or regulations

8. INTELLECTUAL PROPERTY

8.1 All content on the Service (questions, answers, explanations, graphics, software) is owned by my11plus.uk or its licensors.

8.2 You may not:
- Reproduce questions for use outside the Service
- Share content with third parties
- Create derivative works from our content

8.3 Your license to use the Service terminates when your subscription ends.

9. USER DATA AND PRIVACY

9.1 We collect and use your data as described in our Privacy Policy.

9.2 You retain ownership of your personal data.

9.3 We use test results and usage data to:
- Display progress on your parent dashboard
- Improve the Service
- Generate anonymized analytics

10. SERVICE AVAILABILITY

10.1 We strive for 99% uptime but do not guarantee uninterrupted access.

10.2 We may suspend the Service for:
- Maintenance and updates
- Security issues
- Legal or regulatory reasons

10.3 Scheduled maintenance will be announced in advance when possible.

11. LIMITATION OF LIABILITY

11.1 THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

11.2 We are not responsible for:
- Exam results or admission decisions
- Educational outcomes
- Technical issues beyond our control (internet, device problems)
- Third-party services (Auth0, Stripe, Render.com)

11.3 Our total liability to you is limited to the amount you paid in the last 12 months (maximum £59.88).

11.4 We are not liable for indirect, incidental, or consequential damages.

12. INDEMNIFICATION

You agree to indemnify and hold harmless my11plus.uk from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your use of the Service
- Your violation of any third-party rights

13. TERMINATION

13.1 We may terminate or suspend your account immediately if you:
- Violate these Terms
- Engage in fraudulent activity
- Abuse the Service or other users

13.2 Upon termination:
- Your access to the Service ends immediately
- You lose access to all data and analytics
- Outstanding fees remain due

13.3 You may terminate by canceling your subscription.

14. CHANGES TO TERMS

14.1 We may modify these Terms at any time.

14.2 Changes will be posted on this page with an updated "Last Updated" date.

14.3 Continued use after changes constitutes acceptance of new Terms.

14.4 Material changes will be notified via email.

15. DISPUTE RESOLUTION

15.1 Governing Law: These Terms are governed by the laws of England and Wales.

15.2 Jurisdiction: Any disputes will be resolved in the courts of England and Wales.

15.3 Informal Resolution: We encourage you to contact us first to resolve disputes informally.

16. MISCELLANEOUS

16.1 Entire Agreement: These Terms constitute the entire agreement between you and my11plus.uk.

16.2 Severability: If any provision is found invalid, the remaining provisions remain in effect.

16.3 No Waiver: Failure to enforce any right does not waive that right.

16.4 Assignment: You may not assign these Terms. We may assign them to successors or affiliates.

18.4 Parents/guardians are responsible for supervising their child's use of the Service.
